These Terms of Service ("Terms") govern your use of the Hellos website, iOS app, maps, text and iMessage conversations, waitlist, and related services (together, the "Service"). Hellos is a personal map and messaging service, and Toasty is the AI-powered character you talk with through it.
By creating an account, joining the waitlist, sending a message to the Service, or otherwise using it, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 and legally able to agree to these Terms. If you are under the age of majority where you live, use the Service only with permission from a parent or legal guardian.
The Service is currently a limited beta. Access may be invitation-only, features may change or disappear, and availability may be interrupted. We may set reasonable limits to keep the beta safe and reliable.
You are responsible for the device, messaging address, registration link, and access credentials connected to your account. Do not share private registration links or attempt to access another person's account. Tell us promptly at support@heyhellos.app if you believe your access has been compromised.
You opt in by creating an account in our app and sending the first text message to our number yourself. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
If you message us before access is available, we may send one waitlist confirmation and a later availability message to the address you used. Reply STOP to leave the waitlist. Reply START to explicitly resume after opting out.
Some features depend on location permission and may operate in the background if you grant “Always” access. You can change location access in iOS Settings, but place-aware features may stop working. You choose whether to send photos. Photos may include location or capture-time metadata, as explained in the Privacy Policy.
You keep ownership of the messages, photos, notes, labels, and other content you provide. You give us a limited, worldwide license to host, process, reproduce, and display that content only as needed to operate, secure, troubleshoot, and improve the Service. This license ends when the content is deleted from our systems, subject to the retention exceptions in the Privacy Policy.
You are responsible for having the right to submit and share your content. When you choose to send a friend a place, note, message, or photo, you direct us to deliver that content to them. A friend who saves it may keep their own copy.
If you teach Toasty a place missing from our map data, its name and location may become a shared map entry that is not presented as yours. Do not put personal, confidential, or sensitive information in a shared place name.
Toasty's replies are generated with AI and can be incomplete, wrong, or unexpected. Place names, locations, hours, categories, routes, recommendations, and other map information may also be inaccurate or out of date. Use your own judgment and verify important details.
The Service is not an emergency service and does not provide medical, legal, financial, safety, navigation, or other professional advice. Do not rely on it where an error could cause harm, and contact the appropriate professional or emergency service when needed.
You may use the Service for personal, lawful purposes. You may not:
The Service relies on third-party messaging, AI, hosting, database, map, and place-data providers, as well as Apple platforms. Their services may have separate terms and may change or become unavailable. You are responsible for carrier, data, and device charges.
We and our licensors retain all rights in the Service, including its software, design, characters, branding, and content we provide. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service; they do not transfer ownership to you.
You may stop using the Service at any time and may request account deletion as described in the Privacy Policy. We may suspend or end access if you violate these Terms, create risk for users or the Service, or if we discontinue the beta. Where reasonable, we will try to provide notice.
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
To the fullest extent permitted by law, Hellos and the people who operate it will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from the Service. Our total liability for a claim relating to the free beta will not exceed US$100. These limits do not apply where the law does not allow them.
We may update these Terms as the Service changes. We will post the revised version here, change the effective date, and provide additional notice when a change is material. Continued use after the new Terms take effect means you accept them.
